Status: Unregulated
Updated: August 5, 2000

A state hypnotherapy association has been formed. This association is interested in pursuing a license act. The psychology law has been expanded into practice protection, but the bill has scaled back the definition of psychology to "the diagnosis and treatment of mental disorders of individuals," which does not affect hypnotherapists as much as broader definitions have done. In May of 1996 we started to receive information that Cease and Desist orders reported going out to hypnotists at the request of the President-Elect of the Psychology Association. There has been a recent Department of Professional Regulation ruling in favor of the hypnotists (that we are not regulated by the psychology law), but the Psychology Board has continued to send out new Cease and Desist Orders. Several ABH members have received these orders.

The State of Oregon had a criminal statute, 167.870 when prohibited "exhibiting a person in trance," and constituted a ban on stage hypnosis. A constitutional challenge to this bill was threatened for 1997-98 by a NGH stage hypnotist who withdrew when he determined that the AFL-CIO would not pay for his planned lawsuit. However, another stage hypnotist was able to have the law repealed (HB 3002) when this task became a senior project for a local High School. The repeal was effective October 2000

Do we have any recent news on Oregon laws? I have recently received a notice of complaint and investigation from the Oregon Board of Psychologist Examiners, and they will not give me any information about what they find objectionable on my website -- very frustrating!
